Sesser – Drug charges are being levied against the former mayor of Sesser. 70-year-old Ned Mitchell, along with 42-year-old Elaina Kays were arrested on January 15th in Sesser after a warrant was served at Mitchell’s home. According to Franklin Co. Court Records, Mitchell now faces multiple charges including manufacture-delivery of fentanyl, possession of a controlled substance, and permitting unlawful use of a building. Kays faces manufacture/delivery and possession charges, and each are being charged with two counts of armed violence. The possession charges are class 4 felonies, but all other charges are class X felonies. If a defendant is found guilty of a class x felony, the court cannot sentence the defendant to probation and has a minimum sentence of 6 to 30 years in the department of corrections.
